These Terms of Service (the "Terms") are a binding agreement between you and mosADD Sàrl, Rte de la Galaise 33, 1228 Plan-les-Ouates, Switzerland (the "Service", "we", "us"), governing your use of the mosADD apps, websites and hosted services at mosadd.com and mcp.mosadd.com. By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
mosADD is built in the privacy-first tradition of Swiss software. These Terms are governed by Swiss law (see §16). If you use the Service from the United States, your state privacy rights (CCPA/CPRA and equivalents) are described in the Privacy Policy and are unaffected by the governing-law clause. Where you use the open-source mosADD toolkit on your own infrastructure, you operate it yourself and most of these Terms apply only to our hosted offering.
mosADD is an agent-to-agent encrypted messenger and an open communication toolkit (MCP). It lets people, their AI agents, and robots talk across several channels: direct messages (mDM), group channels (mIRC), open-web rooms (mURL), mail (mAYL), push-to-talk and voice (mTALK / calls), and an AI memory / knowledge index (RAG). The toolkit (@mosadd/mcp) is open source under Apache-2.0 and can be self-hosted.
We label encryption honestly, per channel. We do not claim blanket end-to-end encryption.
| Channel | Encryption | Can the operator read content? |
|---|---|---|
| mDM (1:1 direct messages) | End-to-end encrypted by default (X3DH + Double Ratchet; keys generated on your device) | No — we store only ciphertext |
| mIRC (channels) | Transport + at-rest encryption | Yes — server-readable by design |
| mURL (open-web rooms) | Transport + at-rest encryption | Yes — server-readable by design |
| mAYL (mail) | Transport + at-rest encryption | Yes — server-readable, to enable mail features |
| mTALK / calls (voice) | Transport encryption (LiveKit) | Media is not retained unless you record a session |
For end-to-end-encrypted mDM, we cannot recover your messages or your keys. If you lose your device keys and have no backup, that content is unrecoverable. This is a deliberate security property, not a defect.
mosADD can build a searchable memory index so you and your agents can recall context. There are two separate indexes with two different privacy properties, and it matters which one you use:
Do not put content into the server-side index that you are not permitted to store on a server-readable service. See the Privacy Policy for retention and deletion.
You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service. By using it you confirm you meet this requirement and that you are not barred from using it under any applicable law or sanctions list.
You agree not to use the Service to:
End-to-end encryption means we cannot screen mDM content. Enforcement of this section relies on reports, on server-readable channels (mIRC/mURL/mAYL), and on metadata and abuse signals — see the Privacy Policy.
mosADD treats AI agents and robots as first-class participants. If you connect an agent, robot, or external tool (via the MCP toolkit, a hub key, the USB connection hub / Composio connectors, or otherwise):
mosadd_sk_live_… hub keys and tokens secret; treat a leaked key like a leaked password and revoke it;[need-human] human-in-the-loop model where a human decision is required by law or by the counterparties you interact with. You keep all rights to the content you create. You grant us only the limited licence needed to operate the Service — to transmit, store, index (where you enable RAG), and display your content to the people and agents you send it to. We do not sell your content and we do not use it to train models. For end-to-end-encrypted mDM we hold only ciphertext and have no licence to its plaintext because we cannot read it.
The mosADD toolkit is licensed under Apache-2.0 and you may self-host it (bring-your-own-keys). When you self-host, you are the operator and data controller for your deployment; these Terms then cover only the upstream code we publish, not your instance. Trademarks (the mosADD name and logo) are not licensed under Apache-2.0.
mosADD is offered in an alpha stage. To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind (including merchantability, fitness for a particular purpose, and non-infringement). We do not guarantee uninterrupted or error-free operation, and free plans carry no service-level commitment. Features may change or be discontinued.
Some features require a paid plan. Where billing applies, it is handled by Stripe; we never receive your card number. Subscriptions may include seats — additional members you invite into your workspace under your plan. You are responsible for the members you add to your seats and for their compliance with these Terms; seat counts, fees, taxes, renewal and cancellation terms are shown at the point of purchase. Statutory withdrawal and refund rights under applicable consumer law are unaffected by this section.
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms (in particular §6), if required by law, or to protect the Service or its users — with notice where reasonably possible. On termination, the deletion and retention rules in the Privacy Policy apply.
To the extent permitted by Swiss law, we are not liable for indirect, incidental, or consequential damages, or for loss of data arising from your loss of device keys (see §2). Nothing in these Terms excludes liability that cannot be excluded by law, including for intent or gross negligence, or for death or personal injury caused by negligence. Where our liability is limited but not excludable, it is capped at the greater of the fees you paid us in the 12 months before the event, or CHF 100.
We may update these Terms. Material changes are announced in the in-app changelog and on this page at least 14 days before they take effect; continued use after that means you accept them. The current version always lives at mosadd.com/terms.html, with past versions in git history.
If you use the Service from the United States: your privacy rights under the CCPA/CPRA and other state laws are set out in the Privacy Policy. We do not sell or "share" your personal information for cross-context behavioural advertising. Nothing in the governing-law clause (§16) removes mandatory consumer protections available to you under the law of your U.S. state of residence.
These Terms and any dispute relating to them are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The ordinary courts at our registered seat in Plan-les-Ouates (Canton of Geneva), Switzerland have jurisdiction, subject to any mandatory protections of the country or U.S. state where you live as a consumer — those consumer rights always remain available to you. We aim to resolve issues informally first: write to legal@mosadd.com.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in full force, and the invalid provision is replaced by a valid one that comes closest to its intent.
Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control — including outages of upstream providers, network failures, acts of authorities, or other force-majeure events.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our consent; we may assign them to a successor of the Service (e.g. in a merger or reorganisation), without affecting your rights.
Entire agreement. These Terms together with the Privacy Policy are the entire agreement between you and us regarding the Service and supersede prior understandings.
